Explanation of Terms

Visa Classification: The type of nonimmigrant visa you are applying for.

Fee: The reciprocity fee, also known as the visa issuance fee, you must pay. This fee is in addition to the nonimmigrant visa application fee (MRV fee).

Number of Entries: The number of times you may seek entry into the United States with that visa. "M" means multiple times. If there is a number, such as "One", you may apply for entry one time with that visa.

Validity Period: This generally means the visa is valid, or can be used, from the date it is issued until the date it expires, for travel with that visa. If your Validity Period is 60 months, your visa will be valid for 60 months from the date it is issued.

  1. The validity of A-3, G-5, and NATO 7 visas may not exceed the validity of the visa issued to the person who is employing the applicant. The "employer" would have one of the following visa classifications:

    • A-1
    • A-2
    • G-1 through G-4
    • NATO 1 through NATO 6

  2. An E-1 and E-2 visa may be issued only to a principal alien who is a national of a country having a treaty, or its equivalent, with the United States. E-1 and E-2 visas may not be issued to a principal alien if he/she is a stateless resident or national of a country without a treaty.  *When the spouse and children of an E-1 or E-2 principal alien are accorded derivative E-1 or E-2 status and are themselves a national of a country that does not have a treaty with the United States – the reciprocity schedule, including any reciprocity fees, of the principal alien’s country of nationality should be used.  **Spouse and children of an E-1 or E-2 visa principal applicant, where the spouse and children are also nationals of a country that has a treaty with the United States – the reciprocity schedule, including any reciprocity fees, of the spouse and children’s country of nationality should be used.  

    *Example 1: John Doe is a national of Country A that has an E-1/E-2 treaty with the U.S. however his wife and child are nationals of Country B which has no treaty with the U.S. The wife and child would, therefore, be entitled to derivative status and receive the same reciprocity as John Doe, the principal visa holder.

    **Example 2:  Mike Doe is a national of Country Y that has an E-1/E-2 treaty with the U.S. however his wife and child are nationals of Country Z that also has a treaty with the U.S. The wife and child would, therefore, be entitled to derivative status and receive the reciprocity issued to nationals of Country Z.

  3. The validity of H-1 through H-3, O-1 and O-2, P-1 through P-3, and Q visas may not exceed the period of validity of the approved petition or the number of months shown, whichever is less.

    Under 8 CFR §214.2, H-2A and H-2B petitions may generally only be approved for nationals of countries that the Secretary of Homeland Security has designated as participating countries. The current list of eligible countries is available on USCIS's website for both H-2A and H-2B visas. Nationals of countries not on this list may be the beneficiary of an approved H-2A or H2-B petition in limited circumstances at the discretion of the Department of Homeland Security if specifically named on the petition.  

    Derivative H-4, L-2, O-3, and P-4 visas, issued to accompanying or following-to-join spouses and children, may not exceed the validity of the visa issued to the principal alien.

  4. There is no reciprocity fee for the issuance of a J visa if the alien is a United States Government grantee or a participant in an exchange program sponsored by the United States Government.

    Also, there is no reciprocity fee for visa issuance to an accompanying or following-to-join spouse or child (J-2) of an exchange visitor grantee or participant.

    In addition, an applicant is eligible for an exemption from the MRV fee if he or she is participating in a State Department, USAID, or other federally funded educational and cultural exchange program (program serial numbers G-1, G-2, G-3 and G-7).

    However, all other applicants with U.S. Government sponsorships, including other J-visa applicants, are subject to the MRV processing fee.

  5. Under the North American Free Trade Agreement (NAFTA), Canadian and Mexican nationals coming to engage in certain types of professional employment in the United States may be admitted in a special nonimmigrant category known as the "trade NAFTA" or "TN" category. Their dependents (spouse and children) accompanying or following to join them may be admitted in the "trade dependent" or "TD" category whether or not they possess Canadian or Mexican nationality. Except as noted below, the number of entries, fees and validity for non-Canadian or non-Mexican family members of a TN status holder seeking TD visas should be based on the reciprocity schedule of the TN principal alien.

    Canadian Nationals

    Since Canadian nationals generally are exempt from visa requirement, a Canadian "TN' or "TD" alien does not require a visa to enter the United States. However, the non-Canadian national dependent of a Canadian "TN", unless otherwise exempt from the visa requirement, must obtain a "TD" visa before attempting to enter the United States. The standard reciprocity fee and validity period for all non-Canadian "TD"s is no fee, issued for multiple entries for a period of 36 months, or for the duration of the principal alien's visa and/or authorized period of stay, whichever is less. See 'NOTE' under Canadian reciprocity schedule regarding applicants of Iranian, Iraqi or Libyan nationality.

    Mexican Nationals

    Mexican nationals are not visa-exempt. Therefore, all Mexican "TN"s and both Mexican and non-Mexican national "TD"s accompanying or following to join them who are not otherwise exempt from the visa requirement (e.g., the Canadian spouse of a Mexican national "TN") must obtain nonimmigrant visas.

    Applicants of Iranian, Iraqi, Libyan, Somalian, Sudanese, Syrian or Yemeni nationality, who have a permanent resident or refugee status in Canada/Mexico, may not be accorded Canadian/Mexican reciprocity, even when applying in Canada/Mexico. The reciprocity fee and period for "TD" applicants from Libya is $10.00 for one entry over a period of 3 months. The Iranian and Iraqi "TD" is no fee with one entry over a period of 3 months.

  6. Q-2 (principal) and Q-3 (dependent) visa categories are in existence as a result of the 'Irish Peace Process Cultural and Training Program Act of 1998'. However, because the Department anticipates that virtually all applicants for this special program will be either Irish or U.K. nationals, the Q-2 and Q-3 categories have been placed only in the reciprocity schedules for those two countries. Q-2 and Q-3 visas are available only at the Embassy in Dublin and the Consulate General in Belfast.

  7. No S visa may be issued without first obtaining the Department's authorization.

  8. V-2 and V-3 status is limited to persons who have not yet attained their 21st birthday. Accordingly, the period of validity of a V-2 or V-3 visa must be limited to expire on or before the applicant's twenty-first birthday.

  9. Posts may not issue a T-1 visa. A T-1 applicant must be physically present in the United States, American Samoa, the Commonwealth of the Northern Mariana Islands or a U.S. port of entry, where he/she will apply for an adjustment of status to that of a T-1. The following dependents of a T-1 visa holder, however, may be issued a T visa at a U.S. consular office abroad:

    • T-2 (spouse)
    • T-3 (child)
    • T-4 (parent)
  10. The validity of NATO-5 visas may not exceed the period of validity of the employment contract or 12 months, whichever is less.

  11. The validity of CW-1 and CW-2 visas shall not exceed the maximum initial period of admission allowed by DHS (12 months) or the duration of the transition period ending December 31, 2014, whichever is shortest.

  12. The validity of E-2C visas shall not exceed the maximum initial period of admission allowed by DHS (24 months) or the duration of the transition period ending December 31, 2014, whichever is shortest.

 

 

Birth Certificates

Available

Fees: LD$500.00, free for applicants 12 and under

Document Name: Birth Certificate

Issuing Authority: Ministry of Health and Social Welfare, Monrovia.

Special Seal(s) / Color / Format: Blue rectangular stamp from Office of the Principal Registrar.

Issuing Authority Personnel Title: There is no Issuing Authority Personnel Title.

Registration Criteria: Under Liberian law, anyone with knowledge of a birth can register that birth. Supporting documentation is required (such as medical facility records or sworn affidavits), but the origins of this documentation are rarely investigated.

Procedure for Obtaining: Contact the Ministry of Health and Social Welfare to obtain copies of birth certificates.

  • Birth in a Health Facility: Applicants born in a health facility (such as a Clinic, Health Center, or a Hospital) must present their ‘Road to Health’ Card that contains the following information:
    • Date of birth
    • Place of birth
    • Name of health facility
    • Name of medical practitioner, signature, and stamp

The applicant must then complete an application form and provide two (2) photos of themselves and two (2) photos of both parents. Certificates for children 12 years old and younger are free, and are immediately printed. Applicants 13 years old and older must participate in an interview. If qualified, he/she will receive a billing slip to attach to a copy of the application form. The applicant must then take their application to the Liberia Revenue Authority, pay a fee of LD$500.00 to government revenue and obtain a flag receipt. Once they submit the flag receipt to the office of the Director of the Bureau of Vital Statistics, the birth certificate is issued in two (2) days.

  • Birth outside a health facility: Applicants born outside a health facility must bring relatives to confirm the birth by explanation and a paternity letter. The office of the Bureau of Vital Statistics will then refer the applicant to the Monrovia Circuit Court to do an affidavit of confirmation of birth. Upon the submission of the affidavit of confirmation of birth from the court, the applicant will complete an application form with two (2) photos attached. A copy of the form will be attached to a billing slip and given to the applicant. the applicant will take the form and slip to the Liberia Revenue Authority, pay a fee of LD$500.00 and obtain a flag receipt. The applicant will submit the flag receipt to the office of Vital Statistics for the issuance of a birth certificate. The birth certificates are printed at the Ministry of Health, Bureau of Vital Statistics.
  • Persons living overseas: Applicants must submit a request to the nearest Liberian consulate, provide the required documentation and pay the requisite fee charged by the consulate. The Ministry will process the certificate in collaboration with the consulate. If there is no consulate in the applicant’s country of residence, a family member can apply on the applicant’s behalf. The Interview with the applicant shall be done using the most effective and efficient medium.
  • Embassies and consulates abroad are authorized to issue a Birth Affidavit to citizens who have lost or misplaced their original Birth Certificate. This is not a replacement or alternative to a Birth Certificate. More information is available at http://www.liberianembassyus.org/.

Comments: Most births go unregistered until a birth certificate is needed for immigration or another official purpose. Late birth registration is common. Officials sometimes issue birth certificates with little or no supporting documentation, so even genuine documents may contain false information. When a person’s date of birth or identity is in question – such as for age-restricted immigrant visa categories –  reviewers often examine other documents from the same time period, such as school records or other secondary evidence of birth and/or identity.

 

Death Certificates

Issuing Authority Personnel Title: There is no Issuing Authority Personnel Title.

Registration Criteria: To file for a death certificate, an applicant must either have an official record of death from a medical facility, or a confirmed record of the disposition of the body (i.e., funeral home record, photos of burial, etc.)

Procedure for Obtaining: Submit an application in person to the Ministry of Health and Social Welfare to obtain copies of death certificates. Certificate requests are generally processed in three (3) business days.

  • Death in a Health Facility: The Applicant must provide a medical cause of death from the health facility that includes the following information:
  1. The cause of the death.
  2. The date of the death.
  3. The place where the death occurred.
  4. The name of the Medical Physician Assistant/Doctor that pronounced the death.
  5. An attached copy of the Doctor`s license.
  6. All should be stamped with the health facility`s stamp.

Then an application form will be given that contains the following:

  1. The applicant`s name, address, and a photo attached.
  2. The applicant`s relationship to the deceased.

The applicant must then pay a fee of LD$500.00 to government revenue at the Liberia Revenue Authority. Once the Ministry of Health receives the flag receipt, they will issue a death certificate.

  • Death outside of Health Facility: For death occurring in situations like an accident or passing away at home, the applicant must provide the following:
  1. If taken to hospital after death, a DEATH ON ARRIVAL certificate is needed.
  2. If taken to funeral parlors, a FORM FILLED OR A RECEIPT is needed.
  3. If been buried, PHOTOS OF THE FUNERAL SERVICE AND BURIAL are needed.
  4. And some documents about the deceased while alive are needed.

When these conditions are satisfied, the applicant will be sent to the Circuit Court at the Temple of Justice to do an Affidavit of Confirmation of Death.

Upon presenting the Affidavit of Confirmation of Death to the Ministry of Health, an application form will be given to the applicant and instructed to pay a fee of LD$500.00 to government revenue at the Liberia Revenue Authority. When the Ministry of Health receives the flag receipt, they will issue the death certificate.

Marriage Certificates

Available

Fees: USD$50.00 for traditional, $75.00 for Western

Registration Criteria: The marriage process requires signatures from two witnesses and an officiant but DOES NOT require any secondary proof of relationship.

Procedure for Obtaining: Applicants must apply in person at the above listed authority for their marriage type.

  • Liberian Civil Marriage Certificate: An applicant must submit a folder with the following documents at least ten(10) days before the wedding:
  1. A completed application form with two (2) photos - one for the bride and one for the groom.
  2. Two copies of a medical report, one for each person.

Ater submitting the folder, the applicant will receive a billing slip with instruction to pay two fees:

  • USD$75.00 to the government revenue at the Liberia Revenue Authority
  • USD$75.00 at the customer service desk at the Head office of the Center for National Documents and Records/Archives.

Once the applicant submits the flag receipt to the office of the Registrar of Marriage, the office prints the marriage certificate. The Registrar signs it and gives it to the applicant two (2) days before the wedding.

On the wedding day, the bride, groom, witnesses, and the officiating clergy will all sign the certificate. After the wedding, the applicant will return the certificate to the Registrar of Marriages. The Registrar then sends it to the Director General for approval and final recording.

Note: Officials only print these certificates at the head office of the Registrar of Marriages in Sinkor.

  • Liberian Traditional Marriage Certificate: Applicants must visit the Registrar of Traditional Marriage/Divorce in person and request a Certificate.

The process works as follows:

  1. The Registrar sends applicant to the office of the Commissioner of Tribal Affairs for a preliminary interview to confirm the marriage.
  2. If the Commissioner confirms the marriage, the applicant fills out an application form in front of the Registrar of Marriages/Divorce, attaches two (2) passport size photos and submits it to the Registrar.
  3. The Registrar gives the applicant a billing slip to deposit a fee of USD$50.00 into government revenue at the Ministry of Finance and obtain a Flag receipt.
  4. The applicant presents the Flag receipt to the Registrar’s office. The Registrar then sends the case folder to the Office of Procurement to assign a code to the certificate.
  5. The Office of Procurement sends the case folder to the office of the Commissioner for Tribal Affairs, where staff type the certificate.
  6. One typed, the certificate goes back to the Registrar, who signs it. The Registrar then sends it to the Commissioner of Tribal Affairs for verification and to the Assistant Minister of Legal Affairs for final approval.

Comments: Liberia recognizes two different types of marriage: traditional and western. To be legally recognized by the Government of Liberia, marriages MUST be registered (and given the accompanying certificate) in one of these two ways. Secondary evidence may be requested at the time of the interview.

 

Divorce Certificates

Procedure for Obtaining: Applicants must apply in person at the above-mentioned authority for their divorce type. Liberian law requires at least one party in a divorce application be resident in Liberia at the time of the application.

  • Liberian Civil Divorce Certificate: The complainant must work through the following steps:
  1. The complainant hires a lawyer and files a complaint with the Civil Law Court, submitting the marriage certificate and requesting a divorce.
  2. The court issues a writ of summons, calling both parties for an investigation.
  3. Based on the investigation, the judge will make a ruling. If there is no issue of alimony, the judge grants the divorce and the court gives the complainant a billing slip to deposit a fee of USD$50.00 into government revenue at the Liberia Revenue Authority and obtain a flag receipt.
  4. The complainant submits the Flag receipt to the Clerk of the Civil Law Court, who then issues the Bill of Divorcement.

Note on Alimony: If the divorce involves alimony, the judge will request the complainant to pay an additional amount in USD to the court based upon the nature of the divorce (alimony).

  • Liberian Traditional Divorce Certificate: The complainant must work through the following steps:
  1. The complainant will first meet the Assistant Minister for Legal affairs and explain the nature or the reason for the Divorce.
  2. The complainant will have to do a written communication stating the reason for the Divorce and send it to the office of the Assistant Minister for Legal Affairs.
  3. The Assistant Minister for legal Affairs will invite the both parties to chambers. If they both consent to the divorce, then the divorce can be instituted. The complainant will be given a billing slip to deposit the amount of USD$75.00 into government`s revenue at the Ministry of Finance and obtain a flag receipt which will be submitted to the office of the Registrar of Marriages/Divorce for the issuance of a Traditional Divorce certificate.
  4. If there is a disagreement, the Assistant Minister for Legal Affairs will conduct an investigation into the case and based upon the ruling, serve the complainant a billing slip to deposit the amount of USD$75.00 into government`s revenue at the Ministry of Finance and obtain a flag receipt which will be submitted to the office of the Registrar of Marriages/Divorce for the issuance of a Traditional Divorce Certificate.
  • Divorce in the absence of one party: If one party is absent, the divorce process can still move forward. However, someone must represent the absent party in court - either a lawyer or a relative. To do, they must submit a notarized letter proving that the absent person has authorized them to act on their behalf.
  • Divorce by proxy: If both parties are absent, the divorce process can still move forward.
  1. Both parties must have a representative - either a lawyer or a relative – who acts on their behalf.
  2. The Registrar of Marriages/Divorce collects the phone numbers and email addresses of both parties and uses that information to contact and confirm their involvement in the divorce.
  3. Each representative must submit a notarized letter from the person they are representing.
  4. The Registrar conducts a background investigation in the neighborhood where the couple previously lived to verify both their marriage and the ongoing divorce process.
  5. Based upon the findings from the investigation, the Registrar either approves or denies the divorce.

Adoption Certificates

Document Name: Adoption Decree

Issuing Authority: Probate Court at the Temple of Justice

Special Seal(s) / Color / Format: White legal-size paper bearing several rubber stamps (usually red or gold in color) with the court seal. Once registered, the decree will also bear a numerical coding and seal/signature from the Registrar of Deeds and Titles at the National Archives.

Issuing Authority Personnel Title: Presiding Judge of the Probate Court

Registration Criteria: Once the adoption decree is issued by the court, parties must register the adoption decree at the National Archives and pay the required USD$40.00 authentication and registration fees.

Procedure for Obtaining: Parties must appear at the court but are allowed to process an adoption through their attorney or legal representation. Prior to issuance of the decree, parties must provide evidence that they have conducted a home study with Ministry of Health and filed all required petitions, relinquishment statements, and affidavits with the Probate Court.

Police Certificates

Available

Document Name: Police Clearance certificate

Issuing Authority: Records and Identification Division, Liberia National Police

Special Seal(s) / Color / Format: Both the physical and electronic certificates are printed on 8.5” by 11” paper bearing the Liberia National Police badge in yellow in the background. The physical certificate bears stamps from the Records and Identification Division and the Office of the Inspector General. The electronic certificate contains a QR code that leads to a verification page.

Issuing Authority Personnel Title: Two individuals endorse police certificates: The Chief of the Records and Identification Division and the Inspector General of Police.

Registration Criteria: There is no Registration Criteria.

Procedure for Obtaining: Applicants may submit their request in person or online to the Records and Identification Section. Applicants must supply two (2) letters of support – one from a community leader and one from the community police station to begin the police clearance process. The process typically takes one-to-two (1-2) weeks to complete, but has been known to be completed in as little as five (5) business days or as long as three (3) weeks

  • Liberian National Police Clearance
    • Police Clearance for Travelling: To get a police clearance for travel purposes, applicants follow these steps:
  1. The applicant goes to the police depot in their district for a preliminary interview. The interview determines what kind of Police Clearance the applicant needs. The depot commander then conducts a community investigation and, if no negative information is found, issues a letter of clearance.
  2. The applicant takes the letter of clearance to the Headquarters of the Liberia National Police. there, staff give the applicant an application form and a billing slip with instructions to deposit a fee of LD$200.00 into government revenue at the Liberia Revenue Authority.
  3. After making the deposit, the applicant submits a folder to the Record Division of the Liberia National Police containing:
  • A completed application form with four (4) photos attached.
  • The original Flag Receipt obtained from the Ministry of Finance.
  • A copy of the applicant`s passport.
  • A copy of the Interview appointment letter.
  1. The Chief of Record Division conducts an interview and sends a copy of the report to the following units for further checks:
  • Special Investigation Unit
  • Criminal Investigation Division
  • The Crime Lab of the Liberia National Police

They do a background investigation, name check, as well as fingerprint verification.

  1. The results return to the Record Division, where staff prepare the Police Clearance. The Chief of Record Division signs it and sends it to the Director of Police for final approval.

Processing Time: This process takes about 21 working days.

For applicants living out of Liberia: If an applicant lives outside of Liberia and needs a Liberian Police Clearance, they must send their fingerprints to the Liberia National Police through the Police headquarters of the country where they live. The Liberia National Police will then ork with that country’s police through INTERPOL to compare and verify the fingerprints.

  • Police Clearances for Job/School: For Job/School the procedures basically remained the same, except that the applicant must submit a folder containing a completed application form with three (3) photos attached, a Flag receipt, and also undergo an interview which is followed by a series of name checks.
